Hiring an attorney is probably the most critical step in the process of filing a lawsuit. In addition to experience, knowledge, prior success and availability, one should consider the communication level of the attorney and his firm. On a daily basis, I help people get cash advances on their lawsuits. Many of my clients are happy with the level of service they receive from their attorneys, but many are also unhappy. They express their frustration that they "don't know what's going on with the case" and [the attorney's office] "isn't returning phone calls" when they try to get updates. The remedy for this is to carefully select an attorney based on the willingness of the attorney and his firm to communicate. Plaintiffs should look at how quickly their phone calls are returned and and how easy it is to get information, e.g. timeline and recovery expectations, updates, etc. If there is an open line of communication, things tend to go much more smoothly overall for everyone. In addition, if a plaintiff has some basic knowledge of how lawsuits work, he is in a better position. Websites such as HowStuffWorks are helpful for getting information on the lawsuit process.
